DUMAI, SUARAPERSADA.com – Ahli hukum Kehutanan dan Kawasan Hutan, Gunardo Agung Prasetyo SH M.Hum CN, mengungkapkan, “Bila menguasai kawasan hutan tanpa izin Kementerian Kehutanan RI sekarang Kementerian Lingkungan Hidup dan Kehutanan merupakan perbuatan Pidana”.
Pernyataan ini ditegaskan Gunardo Agung Prasetyo SH M.Hum CN, dalam sidang lanjutan perkara Perdata gugatan Legal Standing oleh Yayasan Riau Madani di PN Dumai menggugat Ayu Junaidi, salah seorang pengusaha warga Kota Dumai diduga menguasai Kawasan Hutan sekitar 935 hektar menjadikan perkebunan Kelapa Sawit.
Sidang ini merupakan sidang lanjutan agenda mendengarkan keterangan saksi ahli disidangkan oleh majelis hakim dipimpin hakim Abdul Wahap SH berlangsung di ruang sidang Sri Bunga Tanjung Pengadilan Negeri (PN) Dumai kelas IA, hari ini, Selasa (16/6-2020).
Saksi ahli Gunardo Agung Prasetyo dalam memberikan keterangan keahliannya dipersidangan perkara nomor : 46/Pdt.G/LHK/2019/PN.Dum, dilakukan majelis hakim secara online telekonferen karena saksi ahli Gunardo Agung Prasetyo berada di Jakarta.
Sedangkan kuasa penggugat dalam hal ini Yayasan Riau Madani dipimpin Surya Darma S.Ag dan rekannya Ahmad Joni SH maupun tergugat Ayu Junaidi melalui pengacaranya Mangaratua Tampubolon SH hadir dalam acara persidangan di PN Dumai bersamaan majelis hakim yang memeriksa dan mengadili perkara ini.
Gunardo Agung Prasetyo SH M.Hum CN, merupakan pensiunan dari kementerian lingkungan hidup dan kehutanan yang sekarang menjadi advokat sebagai saksi ahli dalam perkara ini dihadirkan oleh kuasa penggugat Yayasan Riau Madani sesuai kapasitas saksi ahli tentang ahli hukum kehutanan maupun kawasan hutan.
Saksi ahli Gunardo Agung Prasetyo yang diketahui tahun 2016 diangkat sebagai tenaga ahli hukum Dirjen Planologi Kehutanan dan tata lingkungan kementerian lingkungan hidup dan Kehutanan ini menjelaskan penguasaan kawasan hutan harus ada izin pelepasan dari menteri.
Apabila ada penerbitan SKGR bagi pemilik sudah benar pengurusan administrasinya ternyata lahan masuk kawasan hutan apakah legalitas atau alas hak tanah atau SKGR otomatis gugur sebagaimana dipertanyakan kuasa tergugat, menurut saksi ahli bahwa pemerintah sudah mengkaji soal pemetaan kawasan hutan, jadi kalau kawasan hutan belum ada pelepasan jika SKGR diterbitkan menurut saksi SKGR tersebut tidaklah sah.
Sementara itu, Gunardo Agung Prasetyo, saksi ahli yang mengaku terlibat aktif dalam penyusunan PP Nomor 10 tahun 2010 Tentang tata cara Perubahan Peruntukan dan Fungsi Kawasan Hutan serta turut dalam penyusunan UU Nomor 18 Tahun 2013 Tentang Pencegahan dan Pemberantasan Perusakan Hutan dan yang juga turut aktif penyusunan PP Nomor 24 Tahun 2010 Tentang Penggunaan Kawasan Hutan menyebut sudah ada regulasi bila membuka perkebunan apalagi membuka kawasan hutan karenanya disebut suatu perbuatan pidana bila menguasai kawasan hutan tdk ada izin menteri.
Untuk diketahui, Surat Edaran Walikota Dumai menindaklanjuti Surat Gubernur Riau Nomor : 522/Ekbang/35.27 tanggal 14 Desember 2005 telah dikeluarkan surat larangan menerbitkan SKT di dalam Kawasan Hutan.
Dalam Surat Edaran tersebut Walikota Dumai menyebut tidak memberikan toleransi terhadap penerbitan SKT yang berada di Kawasan Hutan atau yang berhutan oleh kepala desa, lurah atau Camat.
Kemudian disebutkan akan menindak secara tegas terhadap aparat yang terbukti memberikan Surat Keterangan Tanah (SKT) dimaksud.
Sedangkan pada poin lainnya Surat Edaran Larangan Menerbitkan SKT didalam Kawasan Hutan itu secara tegas disebut terhadap Penerbitan Sertifikat atau Hak Alas Tanah yang menurut Tata Ruang Berada dalam Kawasan Hutan disebut harus dibatalkan. ** (Tambunan)
